Your use of the website (the “Site”) of the National STEM Honor Society™ (“NSTEM™”) is subject to these Terms of Use (“Terms”). By accessing or using the Site, you agree to be bound by these Terms. NSTEM may update or modify these Terms at any time by posting revised Terms on this page. Your continued use of the Site constitutes acceptance of any changes.
For purposes of these Terms, “NSTEM” refers collectively to the National STEM Honor Society program and its directors, officers, employees, agents, interns, volunteers, contractors, and authorized partners.
Privacy
NSTEM’s collection, use, and protection of personal information is governed by its Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge that you have reviewed and agree to the Privacy Policy.
Trademarks and Other Intellectual Property
All content available on the Site, including but not limited to text, graphics, images, logos, icons, videos, software, and other materials, is protected by applicable copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, transmit, display, or otherwise use any Site content without the prior written consent of NSTEM. You may not use the name “National STEM Honor Society,” “NSTEM,” or any NSTEM trademarks or logos for any commercial, promotional, or other purpose without express written permission.
Acceptable Use of the Site
You agree not to:
- Use any automated system (including robots, spiders, scrapers, or similar tools) to access or collect information from the Site
- Attempt to gain unauthorized access to any portion of the Site, servers, or networks
- Probe, scan, or test the vulnerability of the Site or related systems
- Interfere with the proper functioning of the Site or other users’ access
- Impersonate any person or entity or misrepresent your affiliation
- Use the Site or its content for any unlawful, prohibited, or unauthorized purpose
NSTEM reserves the right to investigate and take appropriate action for violations of this section.
Student and Educational Data
NSTEM works in partnership with schools, educators, parents, and students. When NSTEM receives student information through a school, chapter advisor, or educational partner, NSTEM acts as a school official with a legitimate educational interest as defined under the Family Educational Rights and Privacy Act (FERPA). Student information is used solely for educational, recognition, membership, and program administration purposes.
Children and Minors
The Site is not intended for independent use by children under the age of 13. Participation by minors occurs through school, parent, or educator authorization. NSTEM complies with the Children’s Online Privacy Protection Act (COPPA).
Registration and Account Security
If you are provided with login credentials for restricted areas of the Site, you are responsible for maintaining the confidentiality of your account information. You are responsible for all activity that occurs under your account and agree to notify NSTEM immediately of any unauthorized use or security breach.
Termination of Account
NSTEM reserves the right, at its sole discretion, to suspend or terminate access to the Site or related services without notice if you violate these Terms or if NSTEM is unable to verify or authenticate information you provide. NSTEM shall not be liable for any termination of access.
Disclaimer of Warranties
The Site and its contents are provided on an “as is” and “as available” basis. NSTEM makes no warranties or representations regarding the accuracy, reliability, completeness, or timeliness of the Site or its content.
NSTEM disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
NSTEM does not guarantee that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
Limitation of Liability
To the maximum extent permitted by law, NSTEM shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Site, including loss of data, profits, or business interruption, even if NSTEM has been advised of the possibility of such damages.
Third-Party Links
The Site may contain links to third-party websites provided for convenience only. NSTEM does not endorse or control third-party sites and is not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk.
Risk of Loss
If you purchase physical items through the Site, title and risk of loss pass to you upon delivery of the items to the carrier.
Indemnification
You agree to indemnify, defend, and hold harmless NSTEM from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms.
International Access
NSTEM is based in the United States. If you access the Site from outside the U.S., you do so at your own risk and agree to comply with all applicable local laws regarding data transmission and usage.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
